SECTION 71AE of The Residential Tenancies Act 1997 (2) The tenant may apply in writing to the lessor for the lessor’s consent. (3) The lessor may only refuse consent if the ACAT approves the refusal (4) The lessor may impose a condition on consent (a) if the condition is a reasonable condition about (i) the number of animals to be kept on the premises; or (ii) the cleaning and maintenance of the premises; or (b) with the approval of ACAT (5) The lessor is taken to consent to the tenant’s application unless, within 14 days of receiving the application, the lessor applies to the ACAT under section 71AF

Important Information

The Tenant acknowledges and agrees to the following terms: 1. The lessor has 14 (fourteen) days to approve or decline this application; 2. If declined, the lessor will lodge an application at ACAT for an order to approve the refusal; 3. If approved, you will be advised in writing within 14 days and a Pet Clause will need to be signed by all tenants 4. The Tenant shall be liable for any damage or injury whatsoever caused by the pet/s on the Property, whether they are the Tenant’s pets or their guests’ pets and regardless of their approval status. 5. The Tenant accepts full responsibility and indemnifies the Landlord for any claims by or injuries to third parties or their Property caused by, or as result of actions by their pet/s or their guests pet/s, and regardless of their approval status. 6. The Tenant agrees to arrange for Flea Fumigation at the end of the Tenancy or at a time during the Tenancy as required or requested by the Landlord / Landlord’s Agent to be carried out by a Company complying with Australian Standards. 7. The pet/s are to be outside at all times, unless specified otherwise in the Tenancy Agreement or this Pet Agreement. Guide dogs are an exception. 8. If the pet is a dog, the Tenant agrees to restrain or remove the dog from the premises for the duration of inspections arranged by the Agent with the required notice given. 9. By signing below you are only asking for approval of the above-mentioned pet/s to be accepted at the Property for which you are living and IF approved you agree to the additional *pet clause & terms below.
